Consumer Commerce Rights Policy

Article 1: Scope

This Consumer Commerce Rights (CCR) Policy applies to all purchases of digital products, services, subscriptions, and related goods made through the IHS Store operated by IHS Entertainment Group ("IHS", "we", "us", "our"), including purchases made by customers located in the European Union.

This Policy is a binding part of the Terms of Service and supplements any other applicable legal notices. In the event of conflict, the Terms of Service prevail.

Article 2: Definitions

For clarity:

a) Digital Product — Any software, downloadable file, in-game item, digital service, or digital content offered through the IHS Store.
b) Service — Any task, customization, configuration, or digital work performed for a customer.
c) Subscription — Recurring digital access, membership, or service purchased through the IHS Store.
d) Consumer — A natural person acting for purposes outside their trade, business, craft or profession.

Article 3: Order Confirmation & Delivery

3.1 Upon successful payment, an order confirmation will be sent to the email address associated with your account.

3.2 Delivery of digital products begins immediately when the product is made available, accessed, or downloaded by you. You acknowledge that delivery may begin automatically after purchase.

3.3 For services, delivery begins when work is initiated by IHS.

Article 4: Right of Withdrawal (EU Consumers)

4.1 Under applicable EU law, consumers generally have a 14-day right of withdrawal for purchases of goods and services.

4.2 For digital content not supplied on a tangible medium (e.g., downloads, access), that right is waived when delivery begins immediately after purchase.

By placing an order and accessing or downloading any digital content, you expressly acknowledge and agree that delivery will begin immediately after purchase and that you hereby waive your statutory right of withdrawal.

Article 5: Refund Policy

5.1 General Rule: Due to the immediate delivery of digital products and services, all sales are final unless otherwise required by applicable law.

5.2 Refunds May Be Granted:
Refunds may be issued at the sole discretion of IHS in cases of:

a) Duplicate purchases,
b) Failure of delivery where no access was granted,
c) Proven technical error on IHS systems,
d) Other exceptional circumstances as determined by IHS.

5.3 Refund Process & Timeline:
Refund requests must be submitted through the IHS Helpdesk Portal within 14 days of purchase.
Requests must include:

  • Order number

  • Proof of payment

  • Detailed explanation of the issue

5.4 Refund Decision:
IHS will review the request and notify you of its decision within 14 days after receipt of all required information.

5.5 No Refunds for Change of Mind:
Refunds will not be issued solely for change of preference or change of mind once delivery has occurred.

Article 6: Subscription Terms

6.1 Recurring Charges:
Subscriptions are billed according to the terms displayed at the time of purchase.

6.2 Cancellation:
You may cancel your subscription at any time, which will prevent future recurring charges.
Cancellation does not entitle you to a refund for the billing period in which the cancellation occurs, once it has started.

6.3 Refunds for Subscriptions:
Refunds for subscription charges are dealt with under Article 5 and are granted only in exceptional cases and at the discretion of IHS.

Article 7: Service Orders

7.1 Partial Refunds for Services:
Partial refunds for services may be considered only if work has not started.

7.2 Work Started Definition:
Work is considered started when any configuration, customization, or defined task has been performed or recorded.

7.3 Refund Eligibility:
Requests for partial refunds must be submitted through the IHS Helpdesk Portal within 14 days of purchase and must include explanation and supporting evidence.

Article 8: Chargebacks & Payment Disputes

8.1 You should contact IHS Support before initiating a chargeback with your payment provider.

8.2 Unauthorized chargebacks may result in:

  • Suspension or termination of your account

  • Revocation of access to purchased content

  • Administrative recovery fees

8.3 IHS reserves the right to provide evidence to payment processors and pursue recovery of costs associated with chargebacks initiated without prior communication.

Article 9: Fraud Prevention

9.1 IHS may refuse, delay, or cancel transactions suspected of fraud, abuse, or violation of any policy.

9.2 Fraudulent use of payment methods may result in permanent account termination and legal action.

Article 10: Governing Law & Jurisdiction

10.1 This Policy is governed by the same governing law as the Terms of Service.

10.2 Users agree that any dispute arising from or related to this Policy shall be resolved in accordance with the dispute resolution provisions contained in the Terms of Service.

Article 11: Modifications to This Policy

11.1 This CCR Policy may be updated at any time.
11.2 The latest version is always available on our website.
11.3 Your continued use of the IHS Store after updates constitutes your acceptance of such changes.
